General Terms and Conditions (GTC) of WAM Labs GmbH for the treat App
1. Scope and Provider
These General Terms and Conditions (GTC) govern the use of the application “treat” (hereinafter “App” or “treat App”) and related digital services provided by WAM Labs GmbH (hereinafter “Provider”).

These GTC apply to all contracts between the provider and the users (“Users”) concluded via the treat App or the website www.gotreat.app.
By using the app or related services, the user accepts these GTC.
2. Subject Matter and Description of Services
2.1 The treat App offers digital health and nutrition services, including the collection and management of personal health data, analytical functions, and personalized recommendations.
2.2 New users receive a free trial period (“Free Trial”) of usually 3 days with full access to premium features.
2.3 After the trial period ends, free use automatically terminates. Continued use requires subscription to a paid plan.
2.4 Payment is handled via the payment providers RevenueCat and Supawall. Subscription fees are payable in advance.
2.5 The provider reserves the right to modify, restrict, or expand the scope of services at any time.
3. Conclusion of Contract, Withdrawal, and Duration
3.1 The contract is concluded when the user completes the subscription and the provider confirms it.
3.2 Consumers generally have a 14-day right of withdrawal from the date of contract conclusion. This right expires prematurely if the user explicitly agrees to immediate commencement of the service and acknowledges that withdrawal rights will then be lost (§ 356 para. 4 BGB). Users are clearly informed about this prior to contract conclusion.
3.3 The subscription has a minimum term defined at contract conclusion but no longer than 24 months.
3.4 After the minimum term ends, the subscription automatically renews for the originally agreed term, but no longer than 12 months, unless terminated in due time.
3.5 Users may terminate the subscription at any time, effective at the end of the current term, respecting a notice period of one month. Termination may be effected in writing (e.g., via email), via app functions, or through third-party platforms.
3.6 The right to extraordinary termination for good cause remains unaffected.
4. Prices and Payment Terms
4.1 Subscription prices are visible at the time of contract conclusion and include statutory VAT.
4.2 Payments are made by credit card through the payment providers RevenueCat and Supawall.
4.3 If payments are overdue, access to the app may be blocked until payment is made.
4.4 Refunds of paid fees are excluded for timely ordinary terminations.
5. Terms of Use and Liability
5.1 The app is intended solely for private use. Commercial use requires explicit permission.
5.2 Users agree not to use the app unlawfully.
5.3 The app is provided “as is” without guarantee for continual availability or error-free functioning.
5.4 Liability is limited to intent and gross negligence. In cases of slight negligence, liability exists only for breach of essential contractual obligations (cardinal obligations) and is limited to typical foreseeable damages.
5.5 Liability for injury to life, body, or health remains unaffected.
5.6 The provider is not liable for data loss. Users should regularly back up their data.
6. Data Protection
6.1 The collection, processing, and use of personal data is governed by the provider’s privacy policy available at www.gotreat.app/datenschutz.
6.2 By using the app or concluding the contract, users consent to data processing as described therein.
7. Changes to the GTC and Services
7.1 The provider may amend these GTC for valid reasons (e.g., legal changes, technical developments).
7.2 Changes will be communicated at least 14 days before taking effect by email or in the app.
7.3 Users who have legitimate interest may object within 14 days and terminate the contract effective upon the change.
7.4 The provider may adjust the scope of app services at any time in good faith.
8. Final Provisions
8.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
8.2 The place of jurisdiction is the seat of WAM Labs GmbH, to the extent legally permissible.
8.3 Should any provisions be or become invalid, the validity of the remainder remains unaffected.
